Terms of use

1. Acceptance of terms

By downloading, installing or using the MyFitScan application ("the Application") or accessing the website myfitscan.com ("the Website"), you agree to be bound by these general terms of use ("Terms"). If you do not accept these terms, please do not use our services.

2. Service description

MyFitScan is a health and fitness application powered by artificial intelligence that offers:

  • Body scan through AI photo analysis (front and side)
  • Nutritional analysis through meal photo recognition
  • Personalized coaching through artificial intelligence
  • AI-generated meal plans
  • Progress tracking

3. Health disclaimer

MyFitScan does not constitute professional medical, nutritional or dietary advice. The information, analyses and recommendations provided by the Application are generated by artificial intelligence and are for informational purposes only. They do not replace in any way the consultation of a doctor, dietitian or other qualified health professional.

MyFitScan is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or medical condition. The body composition analysis is an AI-based estimate and may not be fully accurate.

Consult a healthcare professional before starting any dietary or exercise program, especially if you have pre-existing medical conditions.

4. Account creation

To use MyFitScan, you must create an account. You agree to:

  • Provide accurate and up-to-date information
  • Maintain the confidentiality of your login credentials
  • Not share your account with third parties
  • Notify us immediately of any unauthorized use of your account

You must be at least 16 years of age to create an account and use our services.

5. Subscriptions and auto-renewal

MyFitScan offers a limited free version and paid subscriptions ("Pro") providing access to all features. Plan details and pricing are available on the Pricing page.

  • Subscriptions are managed through the App Store (Apple) or Google Play Store
  • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period
  • Cancellation takes effect at the end of the current billing period
  • Refunds are subject to App Store or Google Play Store policies

To cancel your subscription:

  • iOS: Go to Settings > Apple ID > Subscriptions > MyFitScan > Cancel
  • Android: Go to Google Play Store > Menu > Subscriptions > MyFitScan > Cancel

6. User content

By using MyFitScan, you may submit content (photos, messages to the AI coach). You retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free license to use this content for the purpose of providing and improving our services.

You agree not to submit content that is:

  • Illegal, offensive or infringing on the rights of third parties
  • Containing viruses or malicious code
  • Depicting persons without their consent

7. Acceptable use

You agree not to:

  • Use the Application for illegal or unauthorized purposes
  • Attempt to bypass security measures or access restrictions
  • Reverse engineer, decompile or disassemble the Application
  • Use bots, scrapers or other automated means to access the service
  • Intentionally overload our servers or infrastructure

8. Intellectual property

The Application, the Website, their content, design, source code, algorithms and trademarks are the exclusive property of DMC Digital LLC or its licensors. Any unauthorized reproduction or use is prohibited.

9. Service availability

We strive to keep the Application available at all times, but we do not guarantee uninterrupted availability. We reserve the right to suspend, modify or discontinue all or part of the service, temporarily or permanently, with or without notice.

10. Limitation of liability

To the maximum extent permitted by applicable law:

  • The Application is provided "as is" and "as available" without warranty of any kind
  • We do not guarantee the accuracy, reliability or completeness of AI-generated analyses and recommendations
  • Our total liability shall not exceed the amount of subscriptions paid during the last 12 months
  • We are not liable for indirect, incidental or consequential damages

11. Account deletion

You can delete your account at any time from the Application settings. Upon deletion:

  • Your profile, body photos, meal photos, and coaching history will be permanently deleted within 30 days
  • Active subscriptions must be cancelled separately through the App Store or Google Play Store
  • Billing records may be retained as required by law

12. Termination

We reserve the right to suspend or terminate your account in case of violation of these Terms, without notice and without prejudice to any other remedy. You may delete your account at any time from the Application settings.

13. Apple-specific terms

If you downloaded the Application from the Apple App Store, the following additional terms apply:

  • These Terms are between you and DMC Digital LLC, not Apple Inc.
  • Apple has no obligation to provide maintenance or support for the Application
  • Apple is not responsible for any claims related to the Application
  • Apple is a third-party beneficiary of these Terms

14. Google Play-specific terms

If you downloaded the Application from Google Play, the following additional terms apply:

  • These Terms are between you and DMC Digital LLC, not Google LLC
  • Google is not responsible for the Application or its content
  • Google's terms of service for Google Play also apply

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be published on this page with the update date. Continued use of the Application after modification constitutes acceptance of the new terms.

16. Applicable law and jurisdiction

These Terms are governed by the laws of the State of New Mexico, United States. Any dispute relating to the interpretation or execution of these Terms shall be subject to the exclusive jurisdiction of the courts of New Mexico, subject to mandatory consumer protection provisions of the user's country of residence.
