Terms of sale

1. Purpose

These general terms of sale ("Terms of Sale") define the terms and conditions for subscribing to and using paid subscriptions of the MyFitScan application, published by DMC Digital LLC.

3. Offers and pricing

MyFitScan offers the following subscriptions:

  • Weekly subscription: €4.99 incl. tax per week
  • Monthly subscription: €9.99 incl. tax per month
  • Annual subscription: €49.99 incl. tax per year (with 3-day free trial)

Prices are in euros, all taxes included. DMC Digital LLC reserves the right to change its prices at any time. Price changes do not affect current subscriptions.

4. Payment methods

Subscription payments are made through the App Store (Apple) or Google Play Store, depending on the platform used. Accepted payment methods depend on the distribution platform.

Payment is due at the beginning of each subscription period. Payment information is managed directly by Apple or Google — DMC Digital LLC does not have access to your banking data.

5. Free trial

The annual subscription includes a 3-day free trial. During this period, you have full access to all Pro features. If you do not cancel before the end of the trial period, the subscription will be automatically activated and charged at the current rate.

The free trial is limited to one use per Apple ID or Google account.

To avoid being charged: cancel your subscription at least 24 hours before the end of the free trial through the App Store or Google Play Store settings on your device.

6. Right of withdrawal

In accordance with applicable regulations, you have a 14-day period from the date of subscription to exercise your right of withdrawal, without having to provide reasons or pay penalties.

However, if you have started using the service during the withdrawal period, you acknowledge that you expressly waive your right of withdrawal for the period already consumed.

To exercise your right of withdrawal, contact us at support@myfitscan.com or cancel through the App Store / Google Play Store.

7. Auto-renewal

Subscriptions are automatically renewed at the end of each billing period (week, month or year), unless cancelled by the user.

Cancellation must be made at least 24 hours before the end of the current period, through the App Store or Google Play Store settings. Pro access remains active until the end of the paid period.

How to cancel:

  • iOS: Settings > Apple ID > Subscriptions > MyFitScan > Cancel Subscription
  • Android: Google Play Store > Menu > Subscriptions > MyFitScan > Cancel Subscription

8. Service access

A Pro subscription provides access to all Application features, including:

  • Unlimited AI body scans
  • Unlimited meal photo analysis
  • AI Coach 24/7
  • Personalized meal plans
  • Complete progress tracking

9. Guarantees

DMC Digital LLC guarantees the conformity of the service to the descriptions presented in the Application and on the Website. In case of proven non-conformity, the user may request service conformity, a price reduction or contract termination, in accordance with applicable regulations.

10. Liability

DMC Digital LLC shall not be liable for indirect damages resulting from the use or inability to use the service. The total liability of DMC Digital LLC is limited to the amounts actually paid by the user during the last 12 months.

11. Data protection

Personal data collected in the context of subscription and use of subscriptions is processed in accordance with our privacy policy.

12. Mediation

In case of dispute, the user may have recourse to a free consumer mediator. In accordance with European regulations, the user may also use the European Commission's online dispute resolution platform at: https://ec.europa.eu/consumers/odr.

13. Applicable law

These Terms of Sale are governed by the laws of the State of New Mexico, United States. For consumers residing in the European Union, the mandatory consumer protection provisions of their country of residence apply.
